주한 외국대사관이 자국 노동자 산재 대리 신청 가능 – Foreign missions can apply for workers’ comp for their nat’ls

한국에서 일하는 외국인 노동자가 산업재해(산재)를 당한 경우 한국에 있는 해당 국가의 공관이 산재 신청을 대신 할 수 있게 된다. Foreign missions in the country can submit applications on behalf of their nationals working in Korea for workers’ compensation.

근로복지공단은 대사관 등 주한 외국공관에 자국민의 산재 신청을 무료로 대리할 수 있도록 산재 신청 대리권을 부여했다고 26일 밝혔다. 기존에는 외국인 노동자의 직계가족이나 공인노무사, 변호사만 산재 신청 업무를 대리할 수 있었다.

The Korea Workers’ Compensation and Welfare Service on Feb. 26 said it granted foreign embassies and missions the right to file such applications on behalf of their nationals working in the country. Previously, only direct family members of migrant workers, certified labor attorneys and lawyers could do so.

이번 제도 개선을 통해 언어 장벽으로 인한 불편과 불법 브로커 노출 위험, 대리인 선임 비용 부담 등이 해소될 것으로 예상된다는 게 공단 측 설명이다. Through this systematic revision, the service said it expects to alleviate problems arising from the language barrier, vulnerability to illegal brokers and costs of appointing representatives.

1990년대 초반부터 시작된 외국인 노동자 유입 증가에 따라 이들의 산재 신청도 매년 늘어나고 있다. 공단에 따르면 지난해 외국인 노동자의 산재 신청은 9543건으로 5년 전(7581건)에 비해 25.9% 증가했다. 최근 5년간 외국인 노동자의 증가 폭(10.7%)보다 산재 신청 증가 폭이 더 크다.

The number of applications for such claims has increased every year since foreign laborers began entering Korea from the early 1990s. The service said 9,543 applications were filed last year, up 25.9% from 7,581 in 2018 and far higher than the rise of 10.7% in the number of such workers over the five-year period.

근로복지공단은 “올해 산재 신청이 많은 국가의 노동자를 위한 전담 상담원을 배치하고 모바일을 활용한 외국어 산재 신청 안내 서비스의 제공을 추진하는 등 지원을 한층 강화할 예정”이라고 밝혔다.

The service said, “This year, we will boost support by assigning counselors specifically to foreign workers from countries with high demand for submitting applications for industrial accident compensation, as well as provide guides to the application in foreign languages through mobile devices.”
